
This article
aims to approach legal aspects related to indigenous rights in the light of Brazilian
constitutional jurisprudence. The tension between domestic and international
law as interpreted by the Supreme Court reveals the potential conflict related
to the sovereignty principle and the recognition to the right of
self-determination of indigenous people.
